Protecting The Rights Of The Accused
California has responded to the problem of spousal abuse by putting some tough domestic violence laws in place. However, none of that takes away the constitutional rights of the accused. I am prepared to protect those rights in cases involving both of the following charges:
- Criminal domestic violence: If you are accused of physically injuring your current or former spouse, someone you currently or formerly lived with, or someone you have had a child with, you can be charged with the criminal offense of domestic violence.
- Violating a protective order: If you violate a domestic violence protective order — even if the allegations behind the order are false or exaggerated — you can be charged with disobeying a court order, a separate offense from domestic violence itself.
