SB731 (also called the “Clean Slate Act”) allows for the sealing of conviction records and arrest records.
Conviction Records. SB731 allows eligible individuals to have their conviction records sealed. It used to be that if you had your past conviction expunged a record of it nervertheless remained that potential employers, landlords etc. could access. SB731 changed that as these conviction records are sealed and made invisible to almost anyone searching for them.
Arrest Records. SB731 also amended Penal Code section 851.91 to provide that if you were arrested but charges were never filed then you can file a petition with the court to have your arrest record sealed. Once sealed, your arrest record is generally not accessible to the public or most background checks (with some exceptions for public agencies).
