A California county school superintendent is facing drunk driving charges for a second time after an incident that occurred on Nov. 5. Around 2 p.m., the California Highway Patrol says the man drove his pickup into a utility pole. The man was taken into custody after a test showed that his blood alcohol content was 0.19 percent, more than twice the legal limit. No one was injured, and the man was alone at the time. He is not being charged with a felony at present.
His previous charges stemmed from an incident in June. The man spent four days on house arrest and was placed on probation after pleading no contest to the charges. He publicly apologized to the community.
The man is publicly elected, and according to a spokesperson at the El Dorado County Office of Education, the board cannot punish him. The man may be recalled, but it would take a petition signed by 10 percent of the voters. However, the board is meeting to discuss the incident because it did take place during work hours.
As this case demonstrates, a drunk driving charge can have implications for an individual’s career in addition to the legal difficulties. A person who is facing drunk driving charges may wish to consult an attorney. It might be possible to plead guilty to a lesser offense in exchange for a reduced penalty, but a person whose career is affected might want to fight the charges. It may be possible to have the charges dismissed entirely if the defendant’s rights constitutional rights were not observed during the traffic stop.
